    It bears repeating that despite team Trump repeatedly dismissing it as the ‘Russian hoax’ and similar, the CIA did find in December 2016 that Russia had interfered to try and help Trump win. Here’s the details:

    Officials briefed on the matter were told that intelligence agencies had found that individuals linked to the Russian government had provided WikiLeaks with thousands of confidential emails stolen from the Democratic National Committee (DNC) and others.

    The people involved were known to US intelligence and acted as part of a Russian operation to boost Trump and hurt the chances of the Democratic candidate, Hillary Clinton. “It is the assessment of the intelligence community that Russia’s goal here was to favour one candidate over the other, to help Trump get elected,” one said.

    The emails were steadily leaked via WikiLeaks in the months before the election, damaging Clinton’s White House run by revealing that DNC figures had colluded to harm the chances of her nomination rival Bernie Sanders.

    Prosecutors investigated Julian Assange, WikiLeaks, and Roger Stone for the hacking of Democratic National Committee servers as well as for possible campaign finance violations, but ultimately chose not to charge them, newly released portions of the Mueller report reveal.

    Although WikiLeaks published emails stolen from the DNC in July and October 2016 and Stone — a close associate to Donald Trump — appeared to know in advance the materials were coming, investigators “did not have sufficient evidence” to prove active participation in the hacks or knowledge that the electronic thefts were continuing. In addition, federal prosecutors could not establish that the hacked emails amounted to campaign contributions benefitting Trump’s election chances and furthermore felt their publication might have been protected by the First Amendment, making a successful prosecution tenuous.

    The fresh details of former special counsel Robert Mueller’s decision not to charge Assange, WikiLeaks, or Stone for their role in influencing the 2016 election come just a day before voters head to the polls for the 2020 presidential election.

    Separately, prosecutors looked into whether publishing those emails could be viewed as an illegal campaign contribution because they materially benefitted the Trump campaign. But in their analysis, that case would be difficult to make because of the challenges in determining the emails’ value. In addition, they worried that Stone, Assange, and WikiLeaks could all be protected under the First Amendment.

    “Assuming that no coordination with the Campaign occurred,” Mueller wrote, “a criminal prosecution of overseas actors providing non-express-advocacy information to American listeners would likely be difficult.”

    this entire hearing has been conducted in effective secrecy, a comprehensive secrecy that gives sharp insight into the politico-economic structures of current western society. Physical access to the courtroom has been extremely limited, with the public gallery cut to five people. Video link access has similarly been extremely limited, with 40 NGOs having their access cut by the judge from day 1 at the Old Bailey, including Amnesty International, PEN, Reporters without Borders and observers from the European Parliament, among many others. The state and corporate media have virtually blacked out this hearing, with a truly worrying unanimity, and despite the implications of the case for media freedom. Finally, the corporations that act as internet gatekeepers have heavily suppressed social media posts about Assange, and traffic to those few websites which are reporting.

    I am reminded of the words of another friend of mine, Harold Pinter, in accepting the Nobel Prize for Literature. It seems perfectly to fit the trial of Julian Assange:

    It never happened. Nothing ever happened. Even while it was happening it wasn’t happening. It didn’t matter. It was of no interest. The crimes of the United States have been systematic, constant, vicious, remorseless, but very few people have actually talked about them. You have to hand it to America. It has exercised a quite clinical manipulation of power worldwide while masquerading as a force for universal good. It’s a brilliant, even witty, highly successful act of hypnosis.

    Finally and ominously, Baraitser heard arguments on whether the full medical records of Assange from the doctors and psychiatrists who had given evidence should their public be released to the media. They have been requested by the press. The records contain a huge amount of background and many intimate details of Julian’s childhood and relationships which are in evidence but were not given in open court by the doctors. Both defence and prosecution opposed release, but Baraitser kept referring to “open justice”. You will remember that earlier this year, Baraitser decided that it was in the interests of “open justice” to release to the media the identity of Julian’s partner Stella Moris and her children. That too was against the wishes of both prosecution and defence.

    That a judge so intent on shutting down or refusing to hear defence evidence is suddenly so preoccupied with “open justice” when it comes to hurting Assange by release of his deeply personal information, is a great irony. Baraitser will rule on this on Monday and I hope humanity has prevailed with her.

    The US bid to block the Spanish investigation goes hand in hand with other abuses that have been on display in the first week of resumed British extradition hearings, which began on Monday.

    This included the filling of a new superseding indictment of Assange, just weeks out from the start of the hearings. The purpose was to overwhelm Assange’s legal team and defence witnesses with thousands of documents after they had finalised their case. Judge Vanessa Baraitser, who is presiding over the show-trial, assisted these efforts, rejecting a defence request that new material in the indictment be excised, and then dismissing calls for a delay so that Assange’s lawyers could respond to the allegations, which are substantially based upon the slanders of two FBI informants.

    US attempts to prevent the exposure of the CIA spying are of a piece with this. The surveillance is referenced in the skeleton defence argument for the current British extradition hearing, published online, where it is described as follows:

    First, his lawyers were targeted for surveillance operations and their meetings with Mr Assange were recorded by private security agents acting on behalf of the US whilst he was sheltering in the Ecuadorian Embassy. During this time, his lawyers were under physical surveillance by these agents and their offices were broken into… Intrusion into Legal Professional Privilege of this nature is universally recognised as the very height of abuse of power.

    After outlining other abuses, of a similar nature, the defence argument explains:

    All this points to an agenda that is not confined to a bona fide prosecution. It also points to a clear disregard for the rule of law. It violated the sanctity of diplomatic premises. And it took place in this country, which is relevant to the question of abuse.

    Clearly, the Spanish investigation, which the US is seeking to stymie, has major implications for the extradition case and for Assange’s fate.
